Terms of Service

1. Acceptance of Terms

By downloading, installing, or using The Test ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App.

3. User Accounts

To use The Test, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Providing accurate and truthful information during registration
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You are solely responsible for any content you create, upload, or share through the App, including:

  • Profile photos
  • Chat messages
  • Game answers and responses

By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App for the purpose of providing the service.

5. In-App Purchases

The App offers optional premium subscriptions ("The Test Pro") available as auto-renewable subscriptions through Apple's App Store.

  • Subscription plans: Weekly and Annual options are available
  • Free trial: New subscribers may be eligible for a free trial period
  • Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Payment: Payment is charged to your Apple ID account at confirmation of purchase
  • Management: You can manage or cancel your subscription in your App Store account settings
  • Refunds: Refund requests are handled by Apple according to their refund policy

6. Acceptable Use

When using the App, you agree not to:

  • Harass, bully, threaten, or intimidate other users
  • Post or share content that is obscene, offensive, hateful, or discriminatory
  • Send spam, unsolicited messages, or promote commercial products
  • Impersonate another person or create fake accounts
  • Upload content that infringes on the intellectual property rights of others
  • Attempt to hack, reverse-engineer, or disrupt the App or its services
  • Use the App for any illegal or unauthorized purpose
  • Collect or harvest data about other users without their consent

Violations may result in immediate account suspension or termination.

7. Intellectual Property

The App and its original content, features, and functionality are owned by The Test and are protected by international copyright, trademark, and other intellectual property laws. This includes but is not limited to:

  • The App's design, logo, and branding
  • Game mechanics and question formats
  • Character illustrations and graphics
  • Source code and software

You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of the Acceptable Use policy
  • Requests by law enforcement
  • Discontinuation of the App

You may delete your account at any time through the App (Settings → Delete Account). Upon termination, your right to use the App ceases immediately.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any defects in the App will be corrected

10. Limitation of Liability

To the fullest extent permitted by applicable law, The Test and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Any content or conduct of third parties within the App
  • Any other matter relating to the App

11. Indemnification

You agree to indemnify and hold harmless The Test, its developers, and affiliates from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Germany.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
